These General Terms and Conditions establish the conditions for short-term use of the gaming hall in CineStar Megaplex Prishtina Mall cinema, located in Prishtina Mall (hereinafter: GAMING hall), as well as accompanying services (use of CineStar cinema equipment (cinema screen, gaming chairs, internet access), use of the bar in CineStar Megaplex Prishtina Mall cinema, use of the birthday party room in CineStar Megaplex Prishtina Mall cinema, assistance of technical staff, hereinafter: Services) for the purpose of organizing and holding e-sports competitions and gaming events, private gaming and broadcasting gaming events, which the GAMING hall and Services are provided for short-term use by the company Blitz-CineStar LLC, base din Magjistralja Prishtinë-Ferizaj, Km 10-të, Graçanicë, Kosovo, unique ID number: 811930438, hereinafter: “CineStar” or “Blitz-CineStar”).
Please familiarize yourself with these General Terms and Conditions of Use of the GAMING hall before making a decision about short-term use of the GAMING hall. Acceptance of the General Terms and Conditions
By sending an inquiry for the short-term use of the GAMING hall with or without accompanying services, accepting the offer, paying the price, using the GAMING hall or entering the GAMING hall, you accept these General Terms and Conditions of Use of the GAMING hall (hereinafter: “General Terms”), as well as all other rules and conditions for using CineStar services.
For all questions that are not explicitly regulated by these General Terms, the General Terms of Business of Blitz-CineStar available on the website www.cinestarcinemas-ks.eu apply. In case of different regulation of certain issues by these General Terms and other general terms or rules of Blitz-CineStar, the General Terms of Use of the GAMING hall have priority in application.
Changes to the General Terms and Conditions (as defined above)
CineStar reserves the right to modify and/or supplement these General Terms and such changes come into effect on the day of their publication. CineStar advises you to check these General Terms before using the GAMING hall or entering the GAMING hall in order to be informed of any changes to them.
General information and rules for using the GAMING hall
The GAMING hall represents a unique multipurpose cinema-gaming hall that easily transforms from a cinematic wonderland to a large gaming arena. The GAMING hall is designed in a gamer style, and its equipment enables transformation into a gaming battlefield with an emphasis on the experience of playing on a large screen and with top-notch surround sound, with a capacity of 182 seats with VIP Premium; VIP Relax and LoveBox seats with additional 10 seats for gaming event. Through these General Terms and Conditions, CineStar wishes, among other things, to appropriately indicate to users the possibilities of using the GAMING hall for the following purposes:
e-Sport: a zone with 10 gaming positions and a central caster position. The GAMING hall becomes a location for a fabulous offline show. The full capacity of the GAMING hall is available.
Private gaming: gaming experience for citizens on a big screen with a capacity of up to 20 people in predetermined terms. The client is obliged to have their own gaming consoles, controllers, and games, and the CineStar team prepares all other necessary equipment (state-of-the-art big screen, top-notch surround sound, etc.). The client is responsible for updating the gaming consoles at home to ensure smooth gaming. It is possible to organize a gaming party with accompanying services.
Broadcasting gaming events: broadcasting gaming events from the world and the region for which classic cinema tickets are sold to visitors according to the corresponding categories.
Inquiry for renting the GAMING hall and contract conclusion
The client submits a request to CineStar for short-term use of the GAMING hall via email at [email protected] or online via the online form, stating the desired purpose and date of use, no later than seven (7) days prior to the desired date. If the request is approved, CineStar will provide the client with an offer for payment, and the contract is concluded upon the client’s acceptance of the offer and/or payment of the advance (if applicable). The client shall make all payments to CineStar’s accounts, IBAN: XK051501090004363424 (EUR), IBAN: XK051501090004374870 (USD), opened at Raiffeisen bank in Prishtina, Kosovo. After the payment is made, CineStar will issue an invoice to the client in accordance with the offer. In case of additional costs incurred, an additional invoice will be issued to the client, which the client must pay to CineStar’s account mentioned in the previous paragraph. The reservation of the date, as well as the payment for the short-term use of the GAMING hall and services, cannot be made online, but only in the manner described above.
Barriers to concluding a contract for short-term use of the GAMING hall
Blitz-CineStar will not accept a client’s inquiry if the proposed event does not correspond to the atmosphere/interior of the GAMING hall due to the possible damage to the GAMING hall and/or related services and for other legitimate reasons. Blitz-CineStar will not accept a client’s inquiry in the following cases:
Blitz-CineStar reserves the right to cancel and/or terminate the use (even after the contract is concluded) and remove, at the client’s expense, all of the client’s belongings from the GAMING hall and/or other rooms where services are provided, if it is determined that the client is using the GAMING hall for purposes other than those agreed upon and in case of force majeure.
The client may terminate the contract for the use of the GAMING hall without compensation no later than 48 hours before the agreed-upon use of the GAMING hall. In the event of termination of the contract for the use of the GAMING hall within a period shorter than 48 hours before the agreed-upon use of the GAMING hall, the client is obliged to pay Blitz-CineStar a contractual penalty for termination in the amount of 10% of the total price stated in the offer accepted by the client.
In case the client breaches any of its obligations related to the use of the GAMING hall and/or services, Blitz-CineStar has the right to cancel the event. In that case, Blitz-CineStar is authorized to retain the amount paid per offer and charge the client for all additional services and any damage caused by such a breach.
For all outstanding receivables from the client, Blitz-CineStar has the right to retain all of the client’s belongings located in the GAMING hall and/or other rooms where services are provided until the client’s obligations are fully fulfilled. The retained property will be stored by Blitz-CineStar at the client’s expense.
Short-term use of the GAMING hall does not allow for the following:
i. Payment or usage with Stars Club memberships;
ii. Use of any ticket price benefits;
iii. Screening of movies from the regular and extended offer of CineStar cinemas or reproduction of one’s own video content during the use of the GAMING hall.
Liability
GAMING hall is used solely at your own risk.
Users of the GAMING hall are required to treat the space, inventory, and other equipment of Blitz-CineStar in the GAMING hall with due care. In case of any damage to the space, inventory, and/or other equipment of Blitz-CineStar in the GAMING hall or in case of damage caused by the negligence of the user that cannot be repaired or cleaned on the spot, the user agrees to bear the costs of repair, cleaning, or, if necessary, purchasing new equipment or inventory, or replacing the damaged part of the space if the damage is of such a nature and extent that the damaged property of CineStar cannot be repaired or cleaned.
The presence of parents or other responsible adults is mandatory for children in the GAMING hall. By using the service of the GAMING hall, with or without related services, every adult who has brought a child, but is not the parent or legal representative of the child, guarantees to CineStar that the child is temporarily entrusted to the care of the parent/legal representative of the child.
The presence of a child in the GAMING hall cannot be considered as entrusting the child to CineStar or any member of the CineStar staff in terms of responsibility for the child’s actions.
The parent or legal representative of the child or the responsible adult is responsible to CineStar for any damage caused by their child, regardless of personal guilt and regardless of the age of the child.
CineStar is not liable for any damage that may arise from user actions contrary to the rules, safety instructions, and warnings given in these General Terms and Conditions, as well as in the General Terms and Conditions of CineStar’s business, as well as in other rules and terms of use of CineStar’s services valid at the time of the damage.
CineStar cannot be held liable for any loss, damage, or other events that may occur during the use of the GAMING hall, except in cases of intent or gross negligence on the part of CineStar. In no case will CineStar be liable for any damage that may arise as a result of improper actions or actions contrary to these General Terms and Conditions during the use of the GAMING hall, as well as contrary to the General Terms and Conditions of CineStar’s business and other rules and terms of use of CineStar’s services valid at the time of the damage.
CineStar is not responsible for the loss or damage to items left at the entrance to the GAMING hall or in the GAMING hall, nor generally for items brought into the premises where services are provided, i.e., the premises of CineStar, but in case of loss of an item, you can contact a member of the CineStar staff who will check if it has been found.
CineStar reserves the right to ask any Client who does not comply with these General Terms and Conditions to leave the GAMING hall, or the rooms where the Services are provided (CineStar Megaplex Prishtina Mall cinema rooms). CineStar staff have the right to refuse service to Clients if, according to the assessment of CineStar staff, those Clients do not behave appropriately or in accordance with these General Terms and Conditions, the General Terms and Conditions of Blitz-CineStar’s business, as well as all other rules and conditions of use of Blitz-CineStar’s services in effect at the time, and in that case, they will be asked to leave the GAMING hall or the rooms of CineStar Megaplex Prishtina Mall cinema.
During your stay in the GAMING hall and other rooms where the Services are provided, you are obliged to comply with the above-mentioned rules, safety warnings, and instructions of CineStar staff.
Client’s obligations
The client is not allowed to provide third parties with access to the GAMING hall and/or all or some of the Services that are subject to use, in any way, without the prior written consent of Blitz-CineStar.
The client will use the GAMING hall and/or all or some of the Services for the purposes stated in the request and in accordance with applicable regulations and instructions of Blitz-CineStar.
Only food and drinks purchased at the CineStar multiplex sales points are allowed to be brought into the GAMING hall. Blitz-CineStar reserves the right to prohibit access to the GAMING hall if the client has products purchased elsewhere, and has the right to keep such products until the end of the short-term use of the GAMING hall and then return them to their owner.
During use, the sale or free distribution of client products offered by CineStar cinema is not allowed.
The client agrees to keep all of their belongings brought into the GAMING hall and/or Blitz-CineStar premises and Blitz-CineStar is not responsible for any damage or destruction of the client’s belongings.
After the end of the event, the client agrees to return the GAMING hall, bar, and equipment subject to the Services in the condition in which they were received.
The client is fully responsible for any damage to the GAMING hall, bar, and/or equipment that is subject to the Services and agrees to compensate Blitz-CineStar for any such damage without delay or objection upon the request of Blitz-CineStar.
This applies solely to the e-Sport service. The client may start setting up their own items (equipment or client products) in the GAMING hall only at the time previously agreed with Blitz-CineStar and is obliged to remove them immediately after the end of the event. If the client does not remove their belongings from the GAMING hall and/or CineStar cinema bar within the specified timeframe, Blitz-CineStar is not responsible for the client’s belongings left in the GAMING hall and/or bar and it will be considered that the client has abandoned and waived ownership rights to those belongings.
The client is obligated to use the GAMING hall exclusively for legally permitted content and is fully responsible for the content (in any form, including but not limited to audio and video content, spoken, written, or in any other way) communicated during the use of the GAMING hall. Blitz-CineStar is not responsible for any content posted related to the use of the GAMING hall made by the client and the client is solely responsible for them.
The client guarantees that they have the authorization of all intellectual property rights holders and has all copyright and other rights related to the content used or displayed in the GAMING halls, as well as all the rights necessary for public display of the same content.
The client undertakes to compensate for all damages that may arise to Blitz-CineStar d.o.o. as a result of the infringement of copyright or any other rights of third parties related to the content used/displayed in the GAMING hall.
General provisions
The positive regulations of the Republic of Kosovo apply to the relationship between you and CineStar. In case of a dispute, the competent court in Kosovo shall have jurisdiction.
These General Terms and Conditions come into force on the day of publication and apply to all Clients who have submitted an inquiry, accepted an offer, paid the price, or used the gaming halls, bar and/or service delivery after that day. For Clients who have previously concluded a separate contract, these General Terms and Conditions shall become applicable 30 days after the day of publication.
